Clamped drivers 'may have had human rights violated'
Motorists who have saved money by purchasing cheap car insurance - only to lose that cash because their vehicles get clamped - may have had their human rights violated, it has been suggested.
According to research by the RAC Foundation, if the amount landowners are charging to release an auto is too high, such individuals may not have law on their side.
Dr Chris Elliott, who reviewed current regulations regarding parking on private ground, stated clamping cars and demanding "unreasonable" amounts of money to release them goes against the Human Rights Act.
Previously, the courts have found if there are clear signs advising of potential penalties, vehicle owners cannot complain.
However, Dr Elliot stated: "Just as a rugby player might expect to get hurt but not beaten up, a motorist might accept a reasonable fee but not an extortionate one."
Meanwhile, drivers who make sure they do not park in auto clamping areas in an effort to avoid fines may be able to save even more money by searching for cheap car insurance online.
